Works that DO NOT CHANGE the intended use of the space (loggia\/balcony remains a loggia\/balcony)<\/h3>\n<p data-start=\"320\" data-end=\"599\">According to Article 5, Paragraph 9.a of the <strong data-start=\"365\" data-end=\"418\">Ordinance on Simple and Other Buildings and Works<\/strong>, the enclosure of a balcony or loggia that retains its original use may be carried out <strong data-start=\"506\" data-end=\"535\">without a building permit<\/strong>, but only on the basis of a prepared <strong data-start=\"573\" data-end=\"596\">main design project<\/strong>.<\/p>\n<p data-start=\"601\" data-end=\"622\">Such works include:<\/p>\n<ul>\n<li>adding or replacing transparent fa\u00e7ade elements (e.g., glass walls),<\/li>\n<li>adding thermal\/hydro insulation, roofing, ventilation, heating or cooling equipment,<\/li>\n<li>works on electrical installations, sewage, water supply, gas installations, etc.<\/li>\n<li>These works are considered <strong data-start=\"898\" data-end=\"926\">regular management tasks<\/strong> and require:<\/li>\n<li data-start=\"944\" data-end=\"1015\">an <strong data-start=\"947\" data-end=\"981\">absolute majority of co-owners<\/strong> if financed from private funds,<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 data-start=\"1118\" data-end=\"1191\">2. Works that CHANGE the intended use (e.g., loggia becomes a room)<\/h3>\n<p data-start=\"1193\" data-end=\"1455\">If the enclosure changes the intended use of the space, and the balcony\/loggia becomes living space (e.g., extension of a room or kitchen), this constitutes a <strong data-start=\"1352\" data-end=\"1370\">reconstruction<\/strong>.<br data-start=\"1371\" data-end=\"1374\" \/>In accordance with the <strong data-start=\"1397\" data-end=\"1417\">Construction Act<\/strong>, a <strong data-start=\"1421\" data-end=\"1440\">building permit<\/strong> is required.<\/p>\n<p data-start=\"1193\" data-end=\"1455\">\n<h3 data-start=\"1462\" data-end=\"1517\">3. Preparation of unified technical documentation<\/h3>\n<p data-start=\"1519\" data-end=\"1851\">In buildings where several co-owners wish to enclose loggias\/balconies, a <strong data-start=\"1593\" data-end=\"1617\">unified main project<\/strong> can be prepared for the entire fa\u00e7ade.<br data-start=\"1656\" data-end=\"1659\" \/>This documentation does not obligate execution but allows co-owners to carry out works under the same conditions, in compliance with regulations and with aesthetic consistency of the fa\u00e7ade.<\/p>\n<p data-start=\"1519\" data-end=\"1851\">\n<h3 data-start=\"1858\" data-end=\"1910\">4. Obligation to comply with legal regulations<\/h3>\n<p data-start=\"1912\" data-end=\"2094\">Any modification of a building fa\u00e7ade (including the enclosure of loggias and balconies) must comply with applicable laws and regulations, with the necessary consents of co-owners.<\/p>\n<p data-start=\"2096\" data-end=\"2282\">Unauthorized works without a project, without co-owner consent, or without a permit (if required) may result in <strong data-start=\"2208\" data-end=\"2279\">inspection bans, fines, and the obligation to remove executed works<\/strong>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>For the purpose of informing all co-owners about the correct procedure regarding the enclosure of balconies or loggias, we inform you of the following: 1.
