{"id":1416,"date":"2025-07-18T12:02:55","date_gmt":"2025-07-18T10:02:55","guid":{"rendered":"https:\/\/gik-services.hr\/zakon\/obveza-izbora-upravitelja\/"},"modified":"2025-09-05T10:51:51","modified_gmt":"2025-09-05T08:51:51","slug":"obveza-izbora-upravitelja","status":"publish","type":"zakon","link":"https:\/\/gik-services.hr\/en\/zakon\/obveza-izbora-upravitelja\/","title":{"rendered":"Obligation to Appoint a Property Manager"},"content":{"rendered":"<p data-start=\"53\" data-end=\"198\">In accordance with the new Law on the Management and Maintenance of Buildings, two fundamental obligations of all co-owners are prescribed:<\/p>\n<h3 data-start=\"205\" data-end=\"259\"><\/h3>\n<h3>Obligation to elect a co-owners representative<\/h3>\n<p data-start=\"261\" data-end=\"404\">According to Article 42, Paragraph 7 of the Law, co-owners must elect a representative within 60 days of receiving a notice from the property manager.<\/p>\n<p data-start=\"406\" data-end=\"651\">If they fail to do so, pursuant to Article 42, Paragraph 8, the property manager will appoint a compulsory representative, and the fee for this function will be charged from the building\u2019s reserve fund, which means an additional cost for all co-owners.<\/p>\n<h3 data-start=\"658\" data-end=\"705\"><\/h3>\n<h3>\u00a0Obligation to elect a property manager<\/h3>\n<p data-start=\"707\" data-end=\"905\">In accordance with Article 49 of the Law, all co-owners are obliged to elect a property manager who will carry out professional and administrative tasks related to the maintenance of the building.<\/p>\n<p data-start=\"907\" data-end=\"1152\">If the co-owners do not elect a property manager in the prescribed manner, under Article 50 of the Law, the mayor will issue a decision on the appointment of a compulsory manager, through a public call specifying the conditions that managers must meet.<\/p>\n<h4 data-start=\"1369\" data-end=\"1381\"><\/h4>\n<h4 data-start=\"1369\" data-end=\"1381\"><strong>IMPORTANT:<\/strong><\/h4>\n<ul>\n<li>With the introduction of a compulsory manager, co-owners lose the ability to choose and control management costs.<\/li>\n<li>The fees for a compulsory manager are also charged from the building\u2019s reserve fund.<\/li>\n<li>Co-owners\u2019 cooperation in the process of electing both the representative and the manager is a key matter of financial responsibility and legal security for all residents..<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>In accordance with the new Law on the Management and Maintenance of Buildings, two fundamental obligations of all co-owners are prescribed: Obligation to elect a co-owners representative According to Article 42, Paragraph 7 of the Law, co-owners must elect a representative within 60 days of receiving a notice from the property manager.
