{"id":1415,"date":"2025-07-18T12:02:07","date_gmt":"2025-07-18T10:02:07","guid":{"rendered":"https:\/\/gik-services.hr\/zakon\/obveza-izbora-predstavnika-suvlasnika\/"},"modified":"2025-09-05T10:45:29","modified_gmt":"2025-09-05T08:45:29","slug":"obveza-izbora-predstavnika-suvlasnika","status":"publish","type":"zakon","link":"https:\/\/gik-services.hr\/en\/zakon\/obveza-izbora-predstavnika-suvlasnika\/","title":{"rendered":"Obligation to appoint a co-owners representative"},"content":{"rendered":"<p data-start=\"53\" data-end=\"218\">One of the legal obligations of co-owners is<strong data-start=\"53\" data-end=\"218\"> the election of a co-owners representative <\/strong>in accordance <strong data-start=\"53\" data-end=\"218\">with the Law on the Management and Maintenance of Buildings.<\/strong><\/p>\n<p data-start=\"220\" data-end=\"426\">According to Article 42, Paragraph 7 of the Law, co-owners of a building without an elected representative are required to elect one within 60 days of receiving a written notice from the building manager.<\/p>\n<p data-start=\"428\" data-end=\"719\">If this obligation is not fulfilled, pursuant to Article 42, Paragraph 8, the manager will appoint a compulsory representative. The costs for this service, based on the valid price list, will be charged from the building\u2019s reserve fund, which means an additional expense for the co-owners.<\/p>\n<h4 data-start=\"894\" data-end=\"966\"><strong data-start=\"902\" data-end=\"966\">Why is it important for co-owners to elect their own representative?<\/strong><\/h4>\n<ul>\n<li data-start=\"803\" data-end=\"861\">Avoids additional costs for a compulsory representative.<\/li>\n<li data-start=\"864\" data-end=\"941\">The elected representative is a person known and accepted by the co-owners.<\/li>\n<li data-start=\"944\" data-end=\"1057\">The representative represents the interests of all co-owners and communicates with the manager on their behalf.<\/li>\n<li data-start=\"1060\" data-end=\"1179\">The manager does not have the discretionary right to appoint anyone \u2013 the choice lies exclusively with the co-owners.<\/li>\n<\/ul>\n<h4 data-start=\"1314\" data-end=\"1362\"><\/h4>\n<h4 data-start=\"1314\" data-end=\"1362\">Responsibility and protection of the representative<\/h4>\n<p data-start=\"1245\" data-end=\"1414\">The representative does not bear personal liability in terms of financial penalties, provided they perform their duties conscientiously and in accordance with the law.<\/p>\n<p data-start=\"1416\" data-end=\"1597\">According to Article 44 of the Law, in cases of gross neglect of duties, co-owners may decide that the representative must return up to 12 monthly compensations they had received.<\/p>\n<h4 data-start=\"1681\" data-end=\"1717\"><\/h4>\n<h4 data-start=\"1681\" data-end=\"1717\">Recommendation for larger buildings<\/h4>\n<p data-start=\"1647\" data-end=\"1788\">For buildings with a greater number of co-owners, it is recommended to establish a <strong data-start=\"1730\" data-end=\"1752\">Co-Owners\u2019 Council<\/strong> (Article 45, Paragraph 4), which:<\/p>\n<ul>\n<li data-start=\"1791\" data-end=\"1832\">provides support to the representative,<\/li>\n<li data-start=\"1835\" data-end=\"1869\">participates in decision-making,<\/li>\n<li data-start=\"1872\" data-end=\"1923\">facilitates the collection of necessary consents,<\/li>\n<li data-start=\"1926\" data-end=\"1971\">accelerates building management procedures.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>One of the legal obligations of co-owners is the election of a co-owners representative in accordance with the Law on the Management and Maintenance of Buildings.
