{"id":1206,"date":"2025-07-17T12:44:47","date_gmt":"2025-07-17T10:44:47","guid":{"rendered":"https:\/\/gik-services.hr\/pricuva\/"},"modified":"2025-12-01T09:55:51","modified_gmt":"2025-12-01T08:55:51","slug":"pricuva","status":"publish","type":"page","link":"https:\/\/gik-services.hr\/en\/pricuva\/","title":{"rendered":"Reserve Fund"},"content":{"rendered":"<p>The reserve fund represents the financial resources (savings) collected from co-owners, intended to cover the building\u2019s common obligations.<\/p>\n<p><strong>All mandatory building costs,<\/strong> as well as <strong>regular and extraordinary maintenance<\/strong> of common parts and installations, are paid from the reserve fund. The costs financed from the reserve fund are prescribed by law and by a Government regulation of the Republic of Croatia. Co-owners may <strong>also decide<\/strong> that other expenses related to the maintenance of common parts and devices are to be covered from the fund.<\/p>\n<p><strong>\u201cThe property manager, in cooperation with the representative of the co-owners, prepares the Annual Management Program (AMP),<\/strong> or a multi-annual program when applicable. The AMP is a plan in tabular form showing the building\u2019s expected revenues and planned expenditures for the period concerned. Co-owners have the right to submit proposals, remarks, or amendments to the proposed AMP and may adopt or modify it in accordance with the prescribed decision-making procedures.\u201d<\/p>\n<p><span style=\"color: #ba1414;\"><strong>Any unspent reserve fund resources remain available to the building and are carried over into the next calendar year. The purpose of the reserve fund is precisely to accumulate funds for financing future interventions, especially larger maintenance and renovation works.<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Source:<\/strong> <a href=\"https:\/\/www.zakon.hr\/z\/3880\/zakon-o-upravljanju-i-odrzavanju-zgrada\" target=\"_blank\" rel=\"noopener\">Article 18 of the <em data-start=\"4229\" data-end=\"4270\">Building Management and Maintenance Act<\/em> (<em data-start=\"4272\" data-end=\"4313\" data-is-only-node=\"\">Zakon o upravljanju i odr\u017eavanju zgrada<\/em>, Official Gazette NN 152\/2024).<\/a><\/p>\n<p>&nbsp;<\/p>\n<h1><span style=\"color: #bf0b0b;\">OBLIGATION TO PAY THE RESERVE FUND!<\/span><\/h1>\n<hr \/>\n<ul>\n<li>Every owner of an individual unit within a building (apartment, commercial space, etc.) is required to pay a monthly reserve fund contribution (service charge).<\/li>\n<li>The amount of the reserve fund is determined by co-owners through a majority of ownership shares.<\/li>\n<li>Any changes to the amount can also be decided by a majority of signatures, whenever convenient for the co-owners.<\/li>\n<li>The reserve fund may not be lower than <strong data-start=\"530\" data-end=\"542\">\u20ac0.36\/m\u00b2<\/strong> (the legal minimum).<\/li>\n<li>The amount is determined individually for each unit, in proportion to the total area of the apartment\/unit.<\/li>\n<\/ul>\n<hr \/>\n<p><strong>Role of the Property Manager<\/strong><\/p>\n<p>The manager organizes collection of the reserve fund. Funds are paid into the building\u2019s dedicated account and are allocated as needed, in accordance with the law and co-owners\u2019 decisions.<\/p>\n<p>Formula for calculating the minimum legal reserve fund:<br \/>\nReference construction price \u00d7 0.54% annually \u00f7 12 months<\/p>\n<p><strong>Example calculation with current reference construction price:<\/strong><\/p>\n<ul>\n<li>Reference construction price: \u20ac796.34\/m\u00b2<\/li>\n<li>0.54% annually: \u20ac796.34 \u00d7 0.54% = \u20ac4.30 annually per m\u00b2<\/li>\n<li>Monthly amount: \u20ac4.30 \u00f7 12 = \u20ac0.36\/m\u00b2 monthly<\/li>\n<\/ul>\n<p>This obligation is prescribed by the Ownership and Other Real Rights Act (Articles 375\u2013386).<\/p>\n<p>&nbsp;<\/p>\n<h1><span style=\"color: #bf0b0b;\">WHAT IS PAID FROM THE RESERVE FUND?<\/span><\/h1>\n<hr \/>\n<p><strong>Building maintenance<\/strong><\/p>\n<p>\u2022 Repairs and renovation of roof, fa\u00e7ade, foundations, staircases, hallways, balconies, loggias (if common)<br \/>\n\u2022 Repair of cracks, moisture, plaster, paint<br \/>\n\u2022 Replacement and repair of doors and windows in common areas<\/p>\n<p><strong>Installations and equipment<\/strong><\/p>\n<p>\u2022 Maintenance and repair of electrical, plumbing, sewage, gas, and heating installations that are common<br \/>\n\u2022 Elevators (service, repairs, replacement of parts)<br \/>\n\u2022 Fire protection systems (hydrants, extinguishers, emergency lighting)<br \/>\n\u2022 Intercoms, video surveillance, doorphones, communal antennas<\/p>\n<p><strong>Regular costs<\/strong><\/p>\n<p>\u2022 Building insurance against fire and other risks<br \/>\n\u2022 Cleaning of stairwells and common areas (if contracted)<br \/>\n\u2022 Chimney sweep services (mandatory inspections and cleaning)<br \/>\n\u2022 Minor ongoing repairs (e.g., replacement of lightbulbs, locks, handles)<\/p>\n<p><strong>Administrative costs<\/strong><\/p>\n<p>\u2022 Fee for the building manager (legal entity or individual)<br \/>\n\u2022 Compensation for the representative of co-owners (if agreed in the Co-ownership Agreement)<br \/>\n\u2022 Preparation of the annual management program and accounting<\/p>\n<p><strong>Major works and capital maintenance<\/strong><\/p>\n<p>\u2022 Energy renovation (fa\u00e7ade, windows, roof)<br \/>\n\u2022 Replacement of elevators or major installation repairs<br \/>\n\u2022 Structural works on foundations, roofs, common parts<br \/>\n\u2022 Works to improve building safety (fire protection systems, video surveillance if decided by majority)<\/p>\n<p>&nbsp;<\/p>\n<h1><span style=\"color: #bf0b0b;\">WHAT IS NOT PAID FROM THE RESERVE FUND?<\/span><\/h1>\n<hr \/>\n<ul>\n<li>Utilities within apartments (electricity, water, gas, heating)<\/li>\n<li>Repairs and maintenance inside apartments (except when caused by common installations)<\/li>\n<li>Individual co-owners\u2019 expenses<\/li>\n<\/ul>\n<hr \/>\n<p><strong>Where is the Reserve Fund Kept?<\/strong><\/p>\n<ul>\n<li>In a <strong>separate bank account<\/strong> of the building (opened and managed by the manager)<\/li>\n<li>Subject to <strong>inspection and review by co-owners<\/strong><\/li>\n<li>Spending of the reserve fund must be a<strong>pproved by the representative of co-owners and the co-owners themselves<\/strong><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The reserve fund represents the financial resources (savings) collected from co-owners, intended to cover the building\u2019s common obligations.
